There was a calculation error in the Tribunal’s costs table in order 1. The costs table is corrected and replaced with the following: Nicole Marie Osborn must pay Anton Bachmann $3,102.60 immediately, calculated as shown in the table below.
The Bond Centre is to pay the bond of $440.00 (3579686-007) to Anton Bachmann immediately.

Reasons

In my original order of 25 November 2024, I found the tenant liable for rent arrears up to 18 September 2024, which I determined as the end date of the tenancy. Based on my calculation, the rent arrears owing totalled $3,300.00.
The landlord has since requested an amendment, believing the calculation to be incorrect. They referred to the rent summary submitted and highlighted specific discrepancies, stating: At page 7, the payment for 19 July to 26 July was $2.20 ... and for 9 August to 16 August, also $2.20! Therefore, the total rent arrears should be $3,735.60, calculated as 17 weeks at $440 per week, minus $4.40.
Upon reviewing the rent summary, I accept that the tenant made payments of $2.20 on 9 August and 16 August, which had not been accounted for in my original calculation. Additionally, I note that no rent payment was recorded for the period 3 May to 10 May, which was also overlooked.
This oversight was due to the multiple handwritten rent summaries submitted by the landlord, which varied, did not follow standard format and were not easy to follow. While I acknowledge the landlord’s calculation, my recalculated total rent arrears as of 18 September 2024 amount to $3,515.60, not $3,735.60 as claimed by the landlord. The order has been amended accordingly.
This correction ensures accuracy while considering the challenges posed by the landlord’s documentation. It also reinforces the importance of clear and consistent record-keeping in rent disputes to avoid miscalculations.
