How much is owed for rent and water rates?

The tenancy ended on 18 June 2024 when an eviction notice was enforced. A Mediator’s Order dated 6 June 2024 (application 4883740) records the amount of rent and water rates owed as at 6 June 2024. No payments were made by the tenant after that date, leading to the termination Order included in the parties’ agreement coming into effect.

The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy. The tenant does not dispute those claims

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

There was a large quantity of the tenant’s belongings at the premises when the tenancy ended. The landlord gave the tenant the opportunity to remove items he wanted to retain and some belongings were removed. Photographs provided by the landlord which were taken after the tenant had removed the items he could, show a large quantity remaining.

The tenant s correct that the removal charges are high and very little detail is provided in the contractor’s invoice. I am satisfied that the cost reflects the amount of material left at the premises and the invoice provides the loss incurred by the landlord having it removed.

Exit photographs provided by the landlord show that the premises needed cleaning to bring them to a reasonably clean and tidy condition after the tenancy ended. There were areas where the carpet was damaged by paint or crayon. The landlord does not claim recovery of the repair cost. The cost of the attempt to treat those marks by shampooing the carpet is included in the cleaning invoice.

The tenant does not dispute the amount claimed.

The landlord claims the cost for reconnecting power to the premises. The tenant is entitled to make his own arrangements for the supply of electricity to the premises. I am not persuaded that any breach of the tenant’s obligations is proved.

The landlord claims the cost of re-keying the locks. The tenant questions that claim saying that he was happy to return the keys but was given no opportunity to do so.

A tenant is required to return keys at the end of the tenancy. It seems likely that the locks were changed, not because the tenant had breached that obligation but as part of the standard practice when evictions are enforced. If the tenant was not in breach of his obligation to return the keys, I do not find a basis proved for the landlord to claim that cost from the tenant.

Because Taylor Property Services Limited as Agent for Qian Cao has substantially succeeded with the claim, I reimburse the filing fee.
