The Bond Centre is to pay the bond of $2,780.00 (3470043-006) to Cartel Trading Limited immediately.
Mereana Marupo must pay Cartel Trading Limited $1,795.23 immediately, calculated as shown in the table below:

Reasons

The landlord attended the hearing, conducted via video. The tenant did not join and two subsequent calls to the tenant went unanswered. After the first call went to voicemail, a brief message was left introducing myself and explaining the purpose of the call. The message concluded with the advice I would try a second time after waiting some minutes. I was satisfied adequate service had completed and I continued with the hearing after the second call also went unanswered.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, a possession order as the tenancy ended on 1 August 2024 via a landlord notice to terminate, rent arrears and water rates. The bond was requested by the landlord to offset the debt.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by failing to remedy rent arrears. Previous notices regarding water and removal of a structural were advised but no evidence of other notices was available at the hearing.
The landlord served a 14-day notice on the tenant on 26 June 2024 and the tenant did not remedy the breach within the required period.
It would be inequitable to refuse to terminate the tenancy because the rent remains in arrears and other issues of concern for the landlord exist in this tenancy. The landlord has already provided an extension to the tenant. This ends the tenancy on 15 August 2024 as ordered.
For a second reason, a possession order should be made. The tenancy ended on 1 August 2025, which is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 are satisfied. The landlord has extended the possession until 15 August 2024 for the benefit of the tenant. Filing fee
Because Cartel Trading Limited has wholly succeeded with the claim I must reimburse the filing fee.
