Candice James must pay Four Seasons Realty 2017 Limited as Agent for Annelies and Luke Anderson $1797.09 from the bond, being rent arrears to 6 th August 2024 and reimbursement of the filing fee, as calculated and set out below:
The Bond Centre is to pay $1,797.09 from the bond of $$2,440.00 (6485902- 001) to Four Seasons Realty 2017 Limited as Agent for Annelies and Luke Anderson immediately.
The balance of the bond of $642.91 is to remain at the Bond Centre.

Reasons

The landlord attended the hearing, the tenant did not attend. I rang the mobile number in the application, for the tenant but it went unanswered. I have checked and the tenant was served with a Notice of Hearing. I am proceeding with the hearing in the absence of the tenant.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The tenancy is to terminate at 11.59pm on Tuesday 6 th August 2024.
The landlord provided rent records which prove the amount of $1770.09 owing at the end of the tenancy.
I am satisfied that the landlord has proven their claim for rent arrears.
The landlord advised that the tenant has been a model tenant initially. However, she has been living in Australia and has allowed unknown people to stay at the property without the knowledge of the landlord.
The rent payments have been inconsistent and unreliable. The tenant has not been in regular contact with the landlord regarding if or when she will return to the property.
The landlord is to be refunded the sum of $1797.09 from the bond held at the bond centre. The remainder of the bond is to be retained at the bond centre until the end of the tenancy and after the landlord has been able to assess whether there are any vacated costs.
Because Four Seasons Realty 2017 Limited as Agent for Annelies and Luke Anderson has wholly succeeded with the claim I must reimburse the filing fee.
