The tenancy of Talei Pritchard at 66 Sutton Crescent, Papakura, Papakura 2110 is terminated, and possession is granted to Par Excellence Properties Limited, at midnight on Monday,18 November 2024.
The Bond Centre is to pay the bond of $2,400.00 (5045981-005) to Par Excellence Properties Limited immediately.
Talei Pritchard must pay Par Excellence Properties Limited $7,153.56 immediately, calculated as shown in the table below:
Talei Pritchard is to pay rent of $600 on Wednesday 6 November 2024 being rent due in advance for the period 6 – 12 November 2024 and $514.28 on 13 November being rent due in advance for the period 13 – 18 November 2024 (6 days).

Reasons

Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy. Rent is payable on Wednesdays. Rent arrears owing as at today, together with an additional day of rent due in advance to 5 November 2024, are $9,526.56.
The parties have been before the Tribunal previously in relation to this tenancy (see NZTT 4580030 and 4740589 made on 28 May 2024). In those proceedings the Tribunal made an order for rent arrears but also made substantial orders against the landlord for various failings including failing to maintain.
The tenant said that matters did not improve following the Tribunal order made on 28 May 2024. She intends to file a further claim seeking compensation for the condition of the property from the date of that order to the end of the tenancy.
I am not able to consider the tenant’s application today as it is not before me and has not yet been filed. The only application I have before me is the landlord’s application for termination.
The tenant should ensure that she refers to all orders made in relation to this tenancy in her application so that the Tribunal is fully informed of the background to date.
Because Par Excellence Properties Limited has succeeded with the claim I must reimburse the filing fee.
No orders for name suppression were made in the previous applications and I do not consider that there are any grounds for name suppression in relation to this decision.
