Should Anna’s rent obligation to the landlord be reduced?

Anna wants the Tribunal to order the landlord to refund some rent paid and for her not to have to pay rent to 7 September when the tenancy ends.

On or about 4 June 2024 Anna and the two other tenants renewed their fixed term tenancy at 15 Frederick Street, Te Aro, Wellington by signing another fixed term tenancy to end on 21 July 2025. On 28 June Anna advised the landlord that she preferred a periodic tenancy so she could end the tenancy. Anna’s financial position had changed. She was finding it difficult to manage her commitment to pay rent. However her fellow tenants wanted to stay at the property and did not agree with her request to end the tenancy. They did not want to have to share the premises with someone other than Anna. They agreed to end the tenancy but were not happy about that. Sufficient stress between Anna and the other tenants developed that Anna decided to find somewhere else to live until new tenants were found for the property.

It is difficult to see how Anna’s application could be successful. There are insufficient grounds for the Tribunal to order that the fixed term be reduced to a date earlier than the date the landlord has agreed. Having financial difficulties through employment changes is not unforeseen change in circumstances.

It would be unreasonable for the Tribunal to make the landlord bear the financial burden resulting from Anna’s financial difficulty. The landlord is not responsible for Anna’s change of circumstances. It would be unreasonable for the Tribunal to make the landlord bear the financial burden resulting from Anna’s decision to leave the premises before the end of the tenancy. The landlord is not the cause of the animosity that developed between the tenants.

I have also considered whether the landlord has delayed the process of finding new tenants. The landlord not only had to take Anna’s preferences into account but also the needs of the other tenants and his own need to find suitable tenants.

There is insufficient reason for the Tribunal to make orders reducing Anna’s rent obligation to the landlord. For that reason, the application is dismissed. Filing Fee

Because Anna has not substantially succeeded with the claim, her request for name suppression is not granted. (see Section 95A(1) of the Residential Tenancies Act 1986).
