Reasons

The landlord attended the hearing, the tenant did not attend. I rang three different mobile numbers in the application for the tenant, but they went unanswered. I am satisfied from the Notice of Hearing that the tenant knew of today’s hearing and has chosen not to attend.

The landlord has applied for possession of the premises following the termination of the tenancy.

The tenancy ended on 30 July 2024 which is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 are satisfied.

The landlord has sent a Notice to the tenant on 28 May 2024 advising that the owners were seeking to move into the property. The tenant was given 63 days’ notice to terminate the tenancy. The Tribunal has been provided with a copy of this Notice.

The landlord is aware that the tenant has been moving out but still has rubbish and a trailer left at the property. The tenant has not returned the keys to the landlord.

I am satisfied that the landlord should receive immediate possession of the property as at 3.00pm on Thursday 22 August 2024.

The landlord has not applied for the outstanding rent arrears or potential vacated costs in this application. The landlord will be making that application as soon as they have gained possession of the property.

The Bond Centre is to retain the tenant’s bond until the landlord has possession of the property and any further claims against the bond are settled.

Because Property Brokers Hawkes Bay Limited As Agent For Wairoa Property Investment Ltd has wholly succeeded with the claim I must reimburse the filing fee.
