The tenants did not connect to the video hearing. The tenants were telephoned on the phone number provided but the phone call went unanswered. I am satisfied the tenants were properly served with notice of the hearing by email. The hearing proceeded in their absence.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 1 July 2024. The landlord provided rent records which prove the amount owing at the end of the tenancy was $1,955.00 and I make this order in full.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40(1)(e)(ii)-(v)
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
The landlord provided a photograph of tyres and rubbish left at the property at the end of the tenancy.
The landlord provided confirmation of the Refuse centre disposal fees being $63.00 to dispose of 7 tyres and $16.00 for a bag of rubbish. An invoice was not provided but I accept that the landlord had to dispose of the tyres and rubbish. I make an order for these amounts in full.
The amounts ordered are proved. Landlord’s time
The landlord claimed 2 hours travel time at $75 per hour.
I raised at the hearing that the Tribunal will generally compensate a landlord’s time at the rate of $30 per hour.
The landlord’s submission is that if she had paid someone to undertake the rubbish removal, they would have received the rate claimed.
In addition, she submitted that the rate she charges in her profession is greater than the amount claimed.
I have considered the landlord’s position however the disposal of rubbish does not require particular skill and I consider $60.00 compensates the landlord for their time in disposing of the rubbish. Bond
The bond is to be paid to the landlord immediately to offset the amount ordered. Filing fee
