The landlord attended the hearing which was conducted remotely. Two attempts to reach the tenant by phone were unsuccessful.

A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 22 August 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The tenant was behind on her rent and on 21 August the landlord issued a 14-day notice to remedy. The next day, the landlord received an email from the tenant saying that she could no longer afford the property and had left the keys on the bench. The landlord attended the property and saw that the tenant had moved out and the keys were on the bench.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice up to 12 September 2024, when new tenants started to pay rent.
