The landlord attended the hearing which was conducted by phone. A phone call to Julie Thompson went to voicemail. Dylan Thompson participated. Although he said that he could speak for his mother, in fact relations between them are strained. However, because a call had been made to Ms Thompson, the hearing proceeded.
The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.
In a letter dated 2 July 2024 from New Zealand Insolvency and Trustee Service addressed to Iron Bridge Property Management as a creditor of Dylan Thompson. Mr Thompson had been admitted to the No Asset Procedure on 1 July 2024 and therefore creditors can take no action to recover the debt. Therefore, Iron Bridge is pursuing Ms Thompson.

How much is owed for rent?

The tenancy ended on 12 May 2024. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy was $2,948.36. With refund of the bond the amount was reduced to $1.208.36. The amount ordered is proved.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. Mr Thompson and his flatmate, worked to tidy up the property, and organised a trailer but did not have a car. They were expecting Ms Thompson to provide a car. They said that they cleaned the property.
The photos provided by the landlord show a considerable amount of items piled inside the property and the garage. An itemised invoice for rubbish removal recorded removal of items from the property, and three wheelie bins, noting that there were three truckloads. Including labour and materials, the cost of rubbish removal comes to $830.65 plus GST, which is reasonable.
Although the tenant may have done some cleaning, it is difficult to see that the premises can be left reasonably clean and tidy when there was a lot of rubbish to clear out. The photos show that the toilet was discoloured. The tenant said that this was permanent staining but the property manager said that the toilet was cleaned and the discolouration removed. It was clear from photos that not all surfaces had been cleaned. I am satisfied that that the cleaning fee of $491.48 plus GST is reasonable.
Finally, the landlord claimed for tidying the grounds. The tenant said that the lawns had been mowed, and that is supported by the photos. However, there was an area that had become overgrown and required weeding. The fee of $112.50 is reasonable.
Because Iron Bridge Property Group Limited has wholly succeeded with the claim I must reimburse the filing fee.
