June McFarland owes First Reserve Limited T/A Focus Rental As Agent For Xuefei Leng $2,538.45 (“the debt”), calculated as in the table below:
June McFarland must pay rent and the debt as follows: a. $750.00 for weekly rent by 5:00pm on Friday 15 November 2024, and b. $2,538.45 for the debt by 5:00pm on Monday 18 November 2024.
Payments will be allocated in the following order: rent, rent arrears, water rates and the filing fee.
If the tenant fails to pay rent, rent arrears or water rates by the due dates in order 2: a. The tenancy at 226A Henderson Valley Road, Henderson, Auckland 0612 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee by the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the hearing held by telephone today.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.
Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must make either a final or conditional order to terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
The landlord provided rent and water rates records which prove the amount owing.
Rent is at least 21 days in arrears at the hearing date.
The tenant wants to repay the debt to avoid immediate termination.
I have granted the tenant one final chance to pay the amounts owing. I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
Because First Reserve Limited T/A Focus Rental As Agent For Xuefei Leng has wholly succeeded with the claim I must reimburse the filing fee.
No suppression orders apply.
