Reasons

The landlord attended this remote teleconference hearing.

Only Jed Nicholson attended from amongst the tenants. Calls to the other tenants went to voicemail and could not be connected respectively. The Tribunal may hear matters in the absence of a party where satisfied that notice of the hearing has been given. I am satisfied that notice was given.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The applications for compensation, cleaning and replacement of lightbulbs were withdrawn by the landlord.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing at the end of the tenancy was $6,581.14.

Jed Nicholson said that he had signed a change of tenant form in December 2023 . He said that he had given the form to one of the remaining tenants and thought that it had been lodged with Tenancy Services. The evidence of the landlord was that he had never seen the form and that the tenants recorded on the tenancy with Tenancy Services remained as shown in this hearing. I prefer the evidence of the landlord. In those circumstances, the tenants remain jointly and severally liable.

The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.

The landlord has been unable to arrange with the tenants for the items to be removed.

It is not practicable for the landlord to the return the goods to the tenants. The value of the goods is below the cost of storing, transporting and selling them. Therefore the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.

The landlord has been substantially successful in this hearing and the tenants are ordered to reimburse the filing fee.

The tenant Jed Nicholson, applied for name suppression. The tenant was not wholly or substantially successful in the hearing and the application is dismissed.
