Baylee Reilly owes Rentcare Property Management Limited $1,754.55 (“the debt”) in accordance with the following table:

Baylee Reilly must pay rent and the debt as follows: a. By a payment of 1,754.55 for the debt by 25 November 2024. b. A payment of $715 for rent on Tuesday 26 November 2024 and weekly thereafter.

Payments will be allocated in the following order: rent, rent arrears, and the filing fee.

If Baylee Reilly fails to pay rent within 2 working day of 25 November 2024: a. The tenancy at 10 Rosebank Avenue, Avalon, Lower Hutt 5011 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

The landlord attended the hearing represented by Ms Matangi. There was no appearance for Ms Reilly.

The hearing was set to determine the landlord’s application for termination of the tenancy on the basis of rent arrears. This was a rehearing that had been granted by Tribunal Order, upon Ms Reilly’s application, on 7 November 2024.

Where rent is at least 21 days in arrears on the date the application was filed, as it was here, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

Ms Reilly has not attended the Tribunal to defend the landlord’s application. Despite this, Ms Matangi advises me that Ms Reilly has told her she has been attempting to have Work and Income (WINZ) assist her to make the payment, and they have been paying her rent regularly since the arrears were accrued some months ago.

On this basis I consider it just to make a conditional order and I do so with the landlord’s consent. This is Ms Reilly’s final opportunity to discharge the debt. If she does not, the tenancy will end.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

Because Rentcare Property Management Limited has substantially succeeded with the claim I have reimbursed the filing fee.
