Reasons

The landlord attended the hearing. The tenant did not attend the hearing. An attempt was made to join the tenant to the hearing by telephone, but the call went to voicemail.
The tenant had requested an adjournment as she is overseas. The tenant provided various documents in relation to her mother being unwell and the tenant travelling to Papua New Guinea and Thailand. The tenant left New Zealand in early September 2024 and has only made one rent payment since she has been away. There was no information in the documents as to when the tenant will be returning to New Zealand. She advised that she could attend a hearing by telephone between 18 and 24 November 2024 but it is likely that there are no court dates available during that time.
The tenant has had over one months’ notice of this hearing. The arrears are significant and only one payment of $1,400.00 has been received since she left New Zealand.
The landlord opposed the adjournment due to the rent arrears owed. The request for adjournment was declined and the tenant was given the opportunity to attend the hearing by telephone, but no overseas contact phone number was provided.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
The tenancy is terminated but I have allowed a week for the tenant to make arrangements for her belongings to be removed from the tenancy.
Because Unique Realty Limited As Agent For Louise Laycock has wholly succeeded with the claim I must reimburse the filing fee.
