Reasons

The landlord attended the hearing by remote teleconference. Several attempts were made to contact the tenants on the telephone number provided. All attempts were unsuccessful.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenants have breached their obligations by failing to pay the rent each week when due.
The landlord served a 14-day notice on the tenants on 2 October 2024, and the tenants did not remedy the rent breach within the required period. It would be inequitable to refuse to terminate the tenancy. Without the tenants’ attendance at today’s hearing, coupled with the arrears history, I cannot be satisfied that the tenants will pay the debt within the specified period. I also cannot be satisfied that there will be no further breaches.
It would be inequitable to refuse to terminate the tenancy because of the history of rent arrears.

How much is owed for rent and water rates?

The landlord provided rent records and water rates invoices which prove the amount owing. The landlord also provided updated rent and water ledgers. Having sighted this evidence I am satisfied that the tenants are responsible for these debts.
Because The Rent Shop Limited Acting Agent For Kin Chiu Lo & Caifen Li has wholly succeeded with the claim I must reimburse the filing fee.
