The tenancy of Jarrad Waugh at 547 Otaki Gorge Road, Hautere, RD 2, Otaki 5582 is terminated, and possession is granted to Susan Ann Cherrington and John Bruce Dunnet, at 11:59pm on Tuesday 12 November 2024.
Jarrad Waugh must pay Susan Ann Cherrington and John Bruce Dunnet $1,908.43 immediately, calculated as shown in the table below:

Reasons

Both parties attended the hearing which was held by teleconference.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. No rent has been paid since 11 September 2024, which paid the rent to 17 September 2024.
That being so, under s.55 RTA the Tribunal must make an Order terminating the tenancy unless the tenant is in a position to pay the arrears within a reasonable period and can satisfy the Tribunal that they are likely to breach the obligation to pay rent when due in future (see s.55(1A)). Unfortunately, that is not the case here and the Tribunal must make an Order terminating the tenancy.
The landlords have provided rent records which prove the amount owing at the end of the tenancy.
Power is supplied to the premises through the landlords’ account, though there is a usage meter inside the premises to record power used by the tenant. Power has not been paid for September and October as required by the parties’ agreement. For what I accept are good reasons, the landlords have not felt able to visit the premises to read the meter.
The parties agree that it would be fair to charge power at $80.00 per month for those 2 months, being the monthly average for the period from March 2023 to August 2024 as shown by the records provided by the landlords.
Because Susan Ann Cherrington and John Bruce Dunnet have wholly succeeded with the claim I must reimburse the filing fee.
The tenant prefers that his identifying details be suppressed but the grounds for suppression are not established (see. s.95A RTA).
