The landlord attended the hearing via teleconference. The tenant was called on the number provided but the calls were not answered. The hearing proceeded in her absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
This is a fixed term tenancy which is due to run until 16 July 2025.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 29 October 2024, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord went to the premises to carry out a routine inspection and found the front door deadbolted and no sign of the tenant. The landlord looked through the window and could see that furniture in the lounge had been removed. The landlord spoke to neighbours who said they saw a moving truck at the premises a few weeks prior and the tenant has not been seen since. The landlord found a lot of mail in the mailbox including a hand delivered notice of the inspection on 21 October 2024. The landlord has made multiple attempts to contact the tenant without success.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing to the date of hearing as claimed.
Because the landlord has wholly succeeded with the claim, the tenant must reimburse the filing fee. I decline to award the filing fee for a previous application to the Tribunal as it was declined.
