William Kereama must pay rent and the debt as follows: a. By making weekly rent payments of $650.00 per week in full each Thursday from Thursday 26 December 2024 until the tenancy ends by consent on 31 January 2024, or making a lump sum payment by consent on 26 December 2024 of $4,178.57 for the rental period 18 December 2024 to 31 January 2025; and b. By making one lump sum payment of $2,900.03 to repay the debt on Monday 23 December 2024.

Payments will be allocated in the following order: rent, rent arrears, water rates arrears and the filing fee.

If the tenant fails to pay rent and the debt within 2 working days of the due dates: a. The tenancy at 23 Virgo Place, Glen Eden, Auckland 0602 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Reasons

Both parties attended the hearing.

The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee. The tenant wants to repay the debt to avoid immediate termination. He gave notice to the landlord this morning that he wants to remain in the tenancy until 31 January 2025.

The landlord provided rent records and water rates invoices which prove the amount owing is as follows: a. $2,807.14 rent arrears to 17 December 2024; and b. $65.89 water rates arrears to the end of the November 2024 billing period.

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days, and establish that the tenant has failed to do so. See section 56(1) Residential Tenancies Act 1986.

The tenant breached their obligations by not paying rent and water rates in full and on time, in accordance with the tenancy agreement. On 30 September 2024 the landlord served a 14-day notice on the tenant but the breach was not remedied within the required period. On 18 October 2024, the parties agreed to a repayment plan in a Mediator’s Order. The tenant has not adhered to the payment plan. It would be inequitable to refuse to terminate the tenancy.

Despite my finding that it would be inequitable to refuse to terminate the tenancy, having heard the evidence I am satisfied the tenant has had a payment from his KiwiSaver approved for an amount that will pay the debt within the period specified in the order and that he is unlikely to commit any further breach. I have granted a conditional termination. See section 78(3) Residential Tenancies Act 1986.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Reimbursement of filing fee
