Reasons

The landlord attended the hearing via phone. Two attempts were made to call the tenant on his last known phone number. The first call connected, however there was no audible response. The second call connected but went to voicemail. Background

The premises is a room in a boarding house. On 18 October 2024, the landlord served the tenant with a notice terminating the tenancy under s 66U(1)(a) for threatening to endanger the landlord (and other alleged breaches of the tenancy agreement). Possession

The landlord has applied for possession of the premises occupied by the tenant.

The landlord has given the tenant notice terminating the tenancy and the tenant has not quit the premises within the period specified in the notice. The landlord is entitled to an order for possession of the premises. See section 66Y Residential Tenancies Act 1986. Rent arrears

The landlord has applied for rent arrears and has provided rent records which prove the amount owing to 16 December 2024.

I make an order for rent arrears accordingly. Compensation for overnight visitor

The landlord has also applied for compensation for the tenant having a visitor to stay overnight, in breach of the tenancy agreement. The landlord says the visitor has stayed 76 nights, and pursuant to the tenancy agreement, the tenant must pay $45 per night per visitor, making the total compensation claimed $3,420.00.

However, the landlord has not filed any evidence in support of the claim. During the hearing (conducted via phone) the landlord stated she has photographic evidence of the visitor which supports her claim. The landlord stated it has been the same visitor staying on each occasion.

The landlord has indicated she intends to file a fresh application in relation to other claims she has against the tenant. I therefore permit the landlord to withdraw her claim seeking compensation for a visitor staying overnight, to allow the landlord to file a new claim in the future with evidence.

I remind the landlord that, as with all claims, the applicant is required to establish the claim to the civil law standard of proof, on the balance of probabilities. Filing fee

As the landlord has succeeded with the claim the tenant must reimburse the filing fee.
