The landlord attended the hearing, set down to be conducted via video. Two calls to the tenant went unanswered and to voicemail. After the first call went to voicemail, a brief message was left introducing myself and explaining the purpose of the call. The message concluded with the advice I would try a second time after waiting some minutes. I was satisfied adequate service had completed and I continued with the hearing after the second call also went unanswered.
The landlord has applied for termination of the tenancy, rent arrears, outgoings, and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (“RTA”).
The landlord provided records which prove the amount of rent and electricity owing at the end of the tenancy. The summary accounted for all tenant payments for electricity and rent as due. That means, while the total due is established by the summary, the allocation to rent versus electricity is not exact. I have adopted an approach of applying the full electricity as due and the balance as rent arrears. Nothing turns on this but an alternate approach concluding higher rent arrears and less electricity is equally open.
I adjusted the electricity total downwards by $234.98 as the landlord had allocated to the tenant a share of the daily fixed charge. That is not considered a tenant cost in this instance. See section 39 RTA. Filing fee
Because Alison Prins, Nigel Horsford Prins has substantially succeeded with the claim I have reimbursed the filing fee.
