The Bond Centre is to pay the bond of $2,320.00 to Chipar Holdings Limited immediately.
Karen Pieterse must pay Chipar Holdings Limited $67.00 immediately, calculated as shown in the table below:

Reasons

Only the applicant landlords attended the hearing. The tenant did not join the video meeting and could not be contacted on her cell phone.
The tenant had messaged the remote tenancy registry yesterday advising that she was unwell and could not attend. The registry advised that she would need to provide a medical/doctor’s certificate if she was requesting an adjournment on these grounds. She has not provided that certification or communicated further. The adjournment request is declined. The landlords objected to delaying the hearing, noting that the rent has been significantly in arrears for some time and that the tenant had been advised, well prior to the fixed term expiring on 14/1/2025, that she needed to leave the premises, as the tenancy was not to be renewed.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed and remains more than 21 days in arrears. The tenancy is terminated. The Tribunal must terminate a tenancy if the rent is more than 21 days in arrears, unless the arrears are paid in full by the date of hearing and it can be satisfied that the tenant is unlikely to get into rent arrears again. Neither of these requirements are established and nothing the tenant could have said at the hearing would change this outcome in light of the rent records provided. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord has provided rent records which prove the amount owing at the end of the tenancy. The only issue remaining is the length of time the landlords will permit before the possession order is effective. The landlords agreed to two weeks. The tenant must pay the weekly rent due tomorrow and the rent due next Friday as her bond which is to be released effectively covers only the arrears and not the rent for the next two weeks.
Because Chipar Holdings Limited has wholly succeeded with the claim I must reimburse the filing fee.
