Reasons

The landlord attended the hearing, conducted via video conference. The tenants did not enter the conference and a call out was made. It was answered by one of the tenants but after my introduction the call was terminated.

The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

An earlier expedited abandoned consideration on 14 January 2025 declined to make an order and referred the application for a full hearing.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 23 December 2024 the landlord became aware (or ought to have been aware) that the tenants had left. During a visit that day it discovered other people living there, with them claiming permission of the tenants to do so. The landlord said the occupants told her the tenants had moved out a month ago with no sign they would come back. Those occupants later vacated (date uncertain) and the landlord provided a series of photos taken later on 20 January 2025 that show the premises is clearly abandoned at that date. The electricity was disconnected. The photos show significant rubbish and damage but no sign of occupancy.

The landlord expects to make a further application to the Tribunal.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
