I have carefully considered whether to grant a conditional termination in the circumstances that were explained to me. However, I conclude that the tenancy is to be terminated. The landlord seeks immediate termination given the sums outstanding and the fact that arrears continue to add up. I agree that the arrears are significant and presently are ongoing. No payments at all towards the rent have been made for over eight weeks which is concerning to the landlord, that is understandable.
The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
I have terminated the tenancy from 11.59pm on 7 February 2025 and have awarded arrears to that date. This will give the tenants an opportunity to move and fulfil their end of tenancy obligations (such as cleaning).
As the landlord has been successful, I also reimburse the filing fee.
