Ms Watson attended the hearing together with the owners of the property.
There were two applications set for hearing today, the other being a tenant application for a reduction of the term of the tenancy and compensation for the alleged failure by the landlord to maintain and repair the premises.
This moning I became aware of the tenant’s request for an adjournment made yesterday. She is currently in Scotland dealing with family matters.
I have adjourned the tenant’s application and will issue a separate order on that application.
The landlord has applied for termination of the tenancy, rent arrears and the filing fee.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount of rent owing as of today. The tenant has not paid any rent since 10 December 2024.
When rent is at least 21 days in arears at the date of the application (or the date of hearing following a breach notice) the Tribunal must terminate the tenancy. It has only a limited discretion not to make the order sought.
Here, both parties are seeking to have the tenancy ended anyway, each for different reasons.
I have delayed the possession date. The tenant states that she will return to New Zealand by the end of this week. She then has almost 2 weeks to find other accommodation.
If the tenant succeeds in her application against the landlord, any amount awarded to her will be off set against the amount ordered for rent arrears. The landlord should delay any enforcement action until the tenant’s application is heard.
As the application is successful, the tenant must pay the landlord’s Tribunal filing fee.
