Reasons

Both parties attended the hearing which took place by teleconference.

The hearing was adjourned on 15 May 2025. The tenant raised a set off claim and the matter was adjourned for her to file a counter claim and evidence in support of her claims. One of the claims raised by the tenant was that the premises were not lawful, and the landlord was given an opportunity to file evidence to address this.

The matter was set down for hearing today. The tenant has not filed any application or evidence and advised that she has decided not to proceed with a counter claim at this time.

The landlord filed further evidence including evidence from the council property file. He advised that the premises were built in 1958 and in 1966 the sleepout was built and the council records refer to the conversion to two flats. I have considered the landlord’s evidence. In the absence of any evidence filed by the tenant I find that the tenant has not proved on the balance of probabilities that the premises are unlawful residential premises. Therefore, the landlord claim will proceed.

The landlord has applied for termination of the tenancy, rent arrears and reimbursement of the filing fee.

Rent was at least 21 days in arrears on the date the application was filed. The rent arrears have increased since the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing to the end of the current rent week being 9 July 2025 in the sum of $19,500.

The tenant did not dispute the debt and accepted that the tenancy will be terminated.

The parties agreed on an end date for the tenancy of Sunday 13 July 2025.

The tenant proposed repayment of the debt at a rate of $50.00 per week commencing this Thursday 10 July 2025. The parties agreed to this repayment arrangement as a minimum with an understanding that if the tenant’s circumstances change and she is able to pay a greater amount that she will arrange to do this.

Because Timothy Bowden has wholly succeeded with the claim I must reimburse the filing fee.
