Both parties attended the video hearing.
The tenants were assisted by an interpreter.
The landlord has applied for rent arrears, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The tenancy commenced on 13 January 2024. This was a fixed term tenancy.
The tenants applied to the Tribunal for the reduction of the fixed term tenancy which had been which was due to end on 13 January 2025. That matter was heard by the Tribunal and in a decision dated 25 October 2024, (TT 5019751), the tenants’ application was dismissed. The order recorded that the tenancy was to end on 13 January 2025 or sooner by agreement between the parties.
The landlord said in evidence that they had tried to relet the premises after the tenants had moved out at a reduced rent and had also offered a week’s free rent. The premises remained untenanted as at the date of this hearing. The failure to pay rent had put the owner in a difficult financial position and they were now in the process of selling the premises. The tenants’ evidence was essentially a repetition of the matters raised by them in the previous Tribunal hearing. The Tribunal is not going to simply allow for that matters raised in that previous hearing to be relitigated by the tenants.

The tenancy ended on 13 January 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.
As Auckland Property Management Limited As Agents For Chris Macfarlane has wholly succeeded with the claim I must order the tenants to reimburse the filing fee.
The tenants applied for names pression. The tenants have not been wholly or substantially successful in this matter and the application for name suppression is dismissed.
