The tenancy of Lennex Tie at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord], at 11:59pm on Thursday 27 February 2025.
Lennex Tie must pay [The landlord] $1,575.35 immediately, calculated as shown in the table below:

Reasons

The landlord attended the hearing. The tenant did not.
I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend. I tried to call the tenant twice but got no reply.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and reimbursement of the application fee.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 10 February 2025, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.
The landlord says they were contacted by Police to execute a search warrant at the premises. The search took place, and the landlord says they visited on 4 February 2025 and the premises was in the same condition Police left it in. The building manager says that the tenant has not been seen for over 3 weeks and the landlord has not had any contact.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.
