Reasons

Both parties attended the hearing. Ms Fantham represented the landlord.
The tenant, Mr Kim, had a tenancy of the premises commencing on 26 March 2022. The tenancy ended on 23 February 2025 and Mr Kim applied for compensation for issues arising out of a water leak at the premises.
The house was newly built at the commencement of the tenancy and consists of an open plan kitchen and living area downstairs with a bedroom(s) and bathroom upstairs. On 8 May 2024, a sudden water leak event occurred which appeared to be coming from the ceiling space above the downstairs living area. The landlord arranged for the issue to be investigated but no cause could be found. A similar event occurred again on 15 May and a hoe in the ceiling was cuit to enable further investigation but again no cause could be found. No water was found in the ceiling cavity and the water pipes were dry. The hole in the ceiling was repaired.
The issue occurred again on 15 October and contractors again cut a man-sized hole in the ceiling space above the living room. Mr Kim said the hole was approximately 30 cm by 25cm. Again, no cause for the sudden leak could be found and contractors suggested that the ceiling hole not be repaired immediately in case the issue happened again. The ceiling hole remained unrepaired until after Mr Kim’s tenancy ended.
Mr Kim claims compensation for the inconvenience in having the hole unrepaired from 16 October until the end of the tenancy (approximately four months). He also said that there was a water stain on the wall of the living room caused by the water leaks which was unsightly.
I accept that the unrepaired hole in the ceiling and the unrepaired water mark was inconvenient and unsightly, and I consider that some compensation for the inconvenience is appropriate. Mr Kim said that the ceiling hole meant that the heat pump was less efficient and therefore used more power (he used the heap pump to cool the premises over the summer months), although he was unsure how much more power was used, and he provided no evidence in support of any increase in use. Mr Kim also said that he could not hang a painting on the wall or leave clothes drying on a clothes horse near the hole because of the risk of the water leak happening again. Taking into account all the circumstances I consider $200.00 reasonable to compensate Mr Kim for the issues arising from the water leak.
Mr Kim has been partially successful in his claim, and I consider this an appropriate case to award him payment of the Tribunal application fee.
