Thi Thi Tran must pay [The landlord/s] $585.46 immediately, as calculated in the table below:

Reasons

The landlord attended the hearing. The tenant did not attend and did not respond when telephoned on the number ending in 327.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 3 February 2025 the landlord became aware that the police had raided the property. On 5 February 2025 the landlord undertook an inspection and believed that the property had been abandoned. Belongings had been left at the property and kitchen items which had not been touched. Photographs have been provided of this inspection. The landlord became aware (or ought to have been aware) that the tenant had abandoned the premises on this day. The landlord advised that the tenant has not returned to the property, or paid rent since.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.

The landlord provided rent records which prove the amount owing at the end of the tenancy of $3,385.71. The amount ordered includes rent in lieu of notice of 28 days after the date the landlord should have been aware that the property had been abandoned.
