The Bond Centre is to pay the bond of $2,200.00 (3605144-012) to Yukari Property Management Limited immediately.
Aakash Amy must pay Yukari Property Management Limited $27.00 immediately, calculated as shown in the table below:

Reasons

A representative of the landlord attended the hearing by video link. The tenant did not attend, and calls made to his mobile during the hearing went directly to voicemail.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 10 February 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.
The tenancy was for a fixed term to April 2025. In January, the tenant advised the landlord that his circumstances had changed and that he wanted to end the tenancy. The landlord and tenant began negotiating an early termination of the fixed term. However, he left the premises without further discussion or notice before an agreement was reached. The tenant stopped communicating with the landlord and/or replying to communications on 7 or 8 February 2025. The landlord carried out an inspection on 10 February 2025 and all personal items had been removed and the keys left on the bench. The landlord also gave oral evidence that the power was disconnected but did not provide a copy of any disconnection notice.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord is entitled to rent to the end of the fixed term or when a new tenancy starts (whichever is earlier). The landlord provided rent records which prove the amount owing at the end of the tenancy but advised that it was only seeking rent to 20 February, being the amount of the bond held. I have made an order accordingly.
As the landlord was the successful party, I have awarded reimbursement of the Tribunal application fee.
