Levaai Leatinuu owes Auckland City-Living Management Limited As Agents For Lifu Liu $1,249.06 (“the debt”) in accordance with the following table:
Levaai Leatinuu must pay the debt by 15 April 2025.
Payments will be allocated in the following order: rent, water rates arrears, and then the filing fee.
If Levaai Leatinuu fails to pay the water rates arrears within 2 working days of 15 April 2025: a. The tenancy at 4 Kohiwi Road, Manurewa, Auckland 2102 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If Levaai Leatinuu fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

The landlord attended the hearing represented by Mr Kuan.
The tenant did not attend and did not answer the calls made to her phone during the hearing. She had been notified of the hearing by email and text, accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in her absence.
The landlord has applied for conditional termination of the tenancy, on the basis of water rates arrears.

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so. See section 56(1) RTA.
The tenant has breached her obligations to pay for her water usage. On 11 December 2024 and 24 February 2025, the landlord served 14-day notices on the tenant but the breach was not remedied within the required periods.
In the circumstances I consider it just 1 to grant the conditional termination order 2 sought by the landlord. The landlord wishes to provide the tenant with one further chance to remedy the situation. She is therefore advised to contact her property manager immediately to make arrangements to repay the debt.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) RTA.
Because Auckland City-Living Management Limited As Agents For Lifu Liu has wholly succeeded with the claim I must reimburse the filing fee.
