The landlord attended the hearing, conducted via teleconference.
The first call to the tenant was answered but no response was received after introducing myself as being from the Tribunal. I was satisfied adequate service had completed and I continued with the hearing after the delayed second call went unanswered.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On, or around, 13 March 2025 the landlord became aware that the tenant had abandoned the premises and lodged this application. The landlord later supplied photos (undated) from around that time, taken during a routine inspection. The electricity was disconnected, badly spoilt food was apparent and personal items of the tenant had been removed. The photos provided support the conclusion of the landlord that it was more than likely the tenant had abandoned the premises. The tenant has not responded to the landlord’s communication attempts since. The last rent was received on 7 February 2025.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
