The landlord’s rent ledger proves that rent arrears total $4,035.00 up to the end of the rent week on Sunday 4 May 2025.

The parties say that the landlord has given the tenant a 90-day notice to terminate the tenancy as at 28 May 2025. The Tribunal was not provided with a copy of this. The law in regard to termination of a tenancy for rent arrears

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

A conditional termination order allows a tenant to make repayments towards the debt, on top of weekly rent, to continue the tenancy. Agreement to a final termination date on condition weekly payments are made

The parties have agreed to a final termination date of 15 June 2025 provided that weekly rent and debt repayments of $15.00 per week are made every Thursday starting from today.

I have made this order as am satisfied it is appropriate in the context of the long-term tenancy and because the landlords agree.

If any of the weekly payments of $565.00 are missed (and not made within 1 working day), then the tenancy will not continue until the final termination date and the tenancy will instead end immediately.

This is to ensure the debt does not become any larger. Repayment of the debt after the tenancy ends

The parties have also agreed to ongoing repayments towards the debt of $15.00 per week. I have made this order.

The bond will remain at the Bond Centre until the tenancy ends. There was discussion to the effect that the parties can agree what the bond is to be used for after the final inspection and both sign the bond refund form. For example, if there are end of tenancy costs that the tenant agrees he is responsible for (such as cleaning or rubbish removal), then part of the bond may be allocated to those costs and the remainder to reduce the debt. If there are no end of tenancy costs, all of the bond can be used to reduce the debt.

I add the filing fee to the debt as the landlord’s application is successful.

The landlord is entitled to suppression of its name but does not require this.
