Vili Vili, Christy Terepo owes Porirua Property Management Limited T/A Quinovic Porirua as Agent for the Bennett Family Trust $821.14 (the debt), calculated in the table below:
The tenants are to make weekly payments of $200.00, beginning 20 May 2025, and continuing every Tuesday thereafter until the full debt in order 1 above is repaid.
If the tenants fail to make any payment within 2 working days of the due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.

Reasons

A hearing was held on 14 May 2025 by teleconference. The landlord attended the hearing. The Tribunal was unable to contact the tenant on the phone number provided. I am satisfied that appropriate service of the hearing notice had been complete, and it was reasonable in the circumstances to proceed with the hearing in the tenant’s absence.
The landlord originally filed an application seeking termination of the tenancy due to rent arrears. However, at the hearing, the landlord confirmed that the tenant had since given notice and vacated the premises on 7 April 2025. Accordingly, the application for termination is withdrawn. The landlord now seeks recovery of the rent arrears owing at the end of the tenancy and refund of the bond.
The landlord produced a final rent summary confirming that $2,304.14 in rent arrears remained outstanding at the end of the tenancy. I am satisfied that the rent summary is accurate and that the tenant is liable for the arrears under section 40(1)(a) of the RTA.
The landlord also advised that the tenant, Vili Vili, had contacted her after vacating, and had agreed that the bond should be refunded directly to the landlord to be applied towards the rent arrears. In addition, the tenant had entered into a payment plan to pay the remaining balance at a rate of $200 per week, with payments to continue each Tuesday. The first payment has already been made, and the next instalment was due on 20 May 2025.
Although the tenants did not appear at the hearing, I am satisfied that this payment arrangement is reasonable and has been agreed to by the tenant, Vili Vili. I therefore record the payment plan as a formal order of the Tribunal.
As the landlord has been wholly successful in the claim, I also order the tenants to reimburse the Tribunal filing fee.
