The landlord has applied for termination of the tenancy, rent arrears, water bills, reimbursement of the filing fee and refund of the bond.
This is a tenancy that commenced on 3 October 2024. The rent payment throughout the tenancy have been in arrears, however the rent has not been paid at all since March 2025. The tenant says she contacted WINZ about the arrears in March 2025 and had assumed that the arrears were sorted, and the rent was being paid.
The landlord said that the tenant was aware that this had not happened as they has attended a mediation prior to this hearing, and she had received constant communication about the ongoing arrears.
The tenant accepts that she has not followed up on the rent arrears and rent payments with WINZ. Termination:
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The tenant is not in a position to offer the repayment of the arrears nor confirmation of the rent payments going forward. The Tribunal must terminate the tenancy under these circumstances.
The tenancy is terminated at 11.59pm on Friday 20 th June 2025 and possession is granted to the landlord immediately after that date and time. Rent arrears and water bills:
The landlord provided rent records and water bills which prove the amount owing at the end of the tenancy on 20 June 2025. The rent arrears to 20 June are $9214.29 and the water bills $608.74.
I am satisfied that the landlord has proven their claim for the rent arrears and water bills. Filing fee and bond refund:
The Bond Centre is to refund the bond to the landlord immediately to offset the debt owed by the tenant to the landlord.
Because The Rent Shop Limited As Agent For Danielle & Gerad Lett has wholly succeeded with the claim I must reimburse the filing fee.
