The owner did not attend to give evidence or provide a written statement. I am not satisfied on the basis of hearsay evidence that the owner gave the tenant permission to leave or represented that the bond would be refunded.
There was no application from the tenant to reduce the fixed term because of her health condition. Her evidence was that she had an accident several months before moving to Auckland. Therefore, it does not seem there was an unforeseen change in the tenant’s circumstance as required by section 66 of the Residential Tenancies Act 1986 (the Act): the tenant was aware of the health condition prior to taking on the tenancy.
I find that the tenant is liable under the tenancy agreement until new tenants were found.
There was a final water invoice for $70.94, based on an actual reading. I award the amount claimed. Break Fee
A landlord can recover expenses reasonably incurred in respect of an assignment, subletting, or parting with possession if they provide the tenant with an itemised account.
The landlord says the tenant was emailed an invoice with a due date of 28 April 2025. The invoice itemised expenses at an hourly rate of $65.00 for administration ($65.00) viewings ($260.00) advertising ($150.00) the outgoing inspection ($260.00) and a credit check ($6.00) totalling $741.00.
