The landlord attended the hearing by video conference. I telephoned the tenant however the phone number did not connect.
I continued the hearing in the absence of the tenant as she has been emailed notice of the hearing date and time to her address for service.
The landlord has applied for the full amount of the bond of $2,600.00 saying that the tenant moved out after only one week and did not give the required period of notice. How much is owed for rent or “rent in lieu of notice”?
The tenancy started on 5 April 2025.
On 11 April 2025, the tenant texted the landlord to say she was moving out that day and to consider the text to be her notice.
A tenant must give a landlord no less than 21 days’ written notice if they wish to end a periodic tenancy. Section 51(2A) Residential Tenancies Act 1986.
In this case, the tenant did not give any prior notice.
The purpose of the notice period is so that the landlord has time to find a new tenant so that the property is not left empty for too long.
The landlord found a new tenant from 12 May 2025.
The property was empty from 12 April until 11 May 2025.
The landlord is entitled to receive rent for the 21-day notice period. This is called “rent in lieu of notice”.
The tenant has paid rent for the first week from 5 th to 11 th April 2025. This is shown on the rent ledger supplied by the landlord.
I make an order for rent in lieu of notice of $1,950.00.
The landlord is also entitled to the filing fee on this application.
The balance of the bond will remain at the Bond Centre because the landlord says there were other costs after the tenancy ended.
