The applicant (landlord) attended the hearing. The respondent (tenant) did not appear. Attempts were made to contact the tenant using his only known mobile number; however, the calls were unanswered, and no voicemail could be left.

As the respondent has been properly served, the hearing proceeded in his absence in accordance with section 91 Residential Tenancies Act 1986 (the Act).

The landlord applied for: a. Payment of fent arrears; b. Termination of the tenancy; c. Refund of the bond; d. Possession of the premises; and e. Reimbursement of the applicant’s filing fee. Rent arrears

Should the tenancy be terminated?

The landlord initially applied to the Tribunal for termination due to the tenant’s breach of obligations.

Under the Act, where a breach of the tenancy agreement is capable of remedy, the landlord must first issue a 14-day notice to the tenant requiring the breach to be remedied and then demonstrate that the breach was not remedied within the notice period.

The Tribunal may order termination where, due to the nature or extent of the breach, it would be inequitable to refuse to do so (see section 56(1) of the Act).

The tenant breached their obligations by failing to pay rent as it fell due under the tenancy agreement.

The landlord served a 14-day notice requiring payment of rent, which the tenant did not comply with.

Termination is justified and equitable in this case, as the tenant: a. Vacated the premises without consent; b. Without the landlord’s knowledge or permissions permitted other individuals to occupy the property, which necessitated police involvement to have them removed; c. Has accrued ongoing rent arrears with no payments made; d. Is uncontactable via the email and mobile service details provided in the tenancy agreement; e. Cannot be located including efforts by the police, who separately and additionally contacted the landlord seeking to locate the tenant as the tenancy address was the tenant’s last known residential details.

The Tribunal may also terminate a tenancy under section 61 of the Act where the premises have been abandoned and rent is in arrears at the hearing date.

A tenancy is considered abandoned when the tenant vacates without reasonable excuse or intention to return, fails to notify the landlord, and does not meet ongoing obligations.

While abandonment was not noted in the application or hearing notice, the facts suggest the premises were indeed abandoned.

Additionally, under sections 55 and 56(2) of the Act, where rent is at least 21 days in arrears at the date of the hearing, the Tribunal must terminate the tenancy.

In this case, the rent is more than 21 days in arrears, and accordingly, the tenancy is terminated.

Furthermore, section 55(1)(a) confirms that a tenancy may be terminated where rent was already at least 21 days in arrears at the date of filing the application — which also applies here. Possession
