Reasons

The landlord attended the hearing which was held by teleconference. The tenant did not answer either of the calls made at the scheduled time to the number provided to the Tribunal.
The tenant’s phone number was provided by the tenant on her Pre-Tenancy Application form dated 12 April 2025, and on the Tenancy Agreement dated 15 April 2025.
The tenant was served notice of the hearing and all documentation sent to her residential address as included on her Pre-Tenancy Application form, and to the email address which was a usual means of correspondence between her and the landlord.
Because I am satisfied the tenant has been served notice of the hearing in accordance with the Residential Tenancies Act, 1986 and the tenant has not requested an adjournment, the hearing was conducted in the tenant’s absence.
The landlord has applied for termination of the tenancy, compensation, rent arrears and reimbursement of the filing fee.

How much is owed for rent arrears and compensation?

As stated above, the tenant signed a Tenancy Agreement on 15 April 2025 for the tenancy to begin on 28 April 2025.
The landlord produced a copy of the tenancy agreement, dated, and with what looks like an electronic signature from the tenant. The landlord also produced screenshots of SMS correspondence with the tenant, which include a message “Please find attached the signed agreement” from the tenant, dated 15 April 2025.
The parties to the tenancy agreement are the parties to this application.
I am satisfied that a tenancy agreement was correctly completed and the landlord can rely on it as a contract to rent the premises in question to the tenant.
On the handover date, the tenant did not keep the appointment to receive the keys for the apartment. On making an inquiry to the tenant, the landlord was told that the tenant would no longer be taking the apartment due to visa problems.
The landlord subsequently re-advertised the apartment and found new tenants who were able to move in on 31 May 2025.
The landlord is seeking rent arrears from 28 April 2025 until 31 May 2025, and compensation for re-letting the premises. A rent summary has been provided.
The amount ordered is proved.
The landlord also produced a schedule of costs for re-letting the premises. The only cost incurred to the landlord was a cost for conducting background checks on a tenant. The landlord is also seeking to be compensated at $50.00 per hour for 6 hours of work preparing a new tenancy agreement, viewings, listing the premises for rent, etc.
The landlord is not a professional property manager and does not have overheads associated with running this business. In the circumstances I consider $50.00 per hour to be high, and I consider $30 per hour to be reasonable. This is what I have ordered.
The amount ordered is proved.
Because Katherine Mitchell, Eli Shannon has substantially succeeded with the claim I have reimbursed the filing fee.
