The tenancy of Thomas Mayer at Apartment 619, 5 Whitaker Place, Grafton, Auckland 1010, Pakpal House is terminated, and possession is granted to New Zealand Education Holdings Whitaker Limited T/A UniLodge Auckland City, at 12 noon on Wednesday 25 June 2025.
Thomas Mayer must pay New Zealand Education Holdings Whitaker Limited T/A UniLodge Auckland City $6,969.86 immediately, calculated as shown in the table below.
This order may be enforced immediately.

Reasons

The hearing was conducted by video. Only Ms Guo, for the landlord, attended the hearing. The tenant did not join the hearing from the link provided in the Notice of Hearing. The Tribunal tried calling the tenant on the mobile telephone number he provided to the landlord, without success. I note that the number he provided is an Australian mobile number. Ms Guo said that the tenant refused to provide a New Zealand number.
The landlord has applied for termination of the tenancy, rent arrears and the filing fee. No bond was paid.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is therefore terminated.
The landlord provided rent records to prove the amount owing to today’s date as ordered.
The landlord also sought payment of the bond that the tenant falsely told the landlord he had paid and a $1,800 “break lease fee”. The tenancy was for a fixed term to 9 February 2026.
There is no point in ordering the bond to be paid because it is too late for that to be of any use. The tenant’s liability is limited, at this stage, to paying the rent arrears.
There does not appear to be any legal basis for a payment of a break lease fee. The landlord may apply in due course for loss arising from the tenant’s breach of his contractual obligation to pay rent.
The landlord has succeeded and so I have awarded the filing fee.
Given the high level of rent arrears and the tenant’s conduct to date, I have given permission for this order to be enforced immediately.
