Reasons

The landlord attended the hearing, the tenant did not attend. I rang the tenant on her mobile number twice, it went unanswered. I have checked and there has been no communication with the Tribunal from the tenant seeking an adjournment. I have checked and she was served with the notice of hearing.

I am proceeding with the hearing in the absence of the tenant.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is not capable of remedy, the landlord is not expressly required to serve a 14-day breach notice on the tenant. A breach is not capable to remedy where the thing done, or its effect, cannot be undone.

However, unless the breach is serious, the Tribunal usually requires the landlord to have warned the tenant about the likely consequences of continued breach before it will exercise its discretion to terminate.

The tenant has breached her obligations by failing to pay her rent. The rent arrears are extreme, and the tenant has made no effort to remedy the breach. The landlord has sent a number of 14 day rent arrears notices to the tenant on, 2 November 2024, 11 April 2025, and 8 May 2025. Meetings were had between the parties and discussions on remedying the breach, all to no avail.

The breach is not capable of remedy because despite efforts by the landlord to seek a resolution, the tenant has not sorted out her rent arrears.

It would be inequitable to refuse to terminate the tenancy. The rent arrears are significant and cannot be allowed to continue. The landlord is suffering financial hardship due to the rent being unpaid.

The tenancy is terminated at 11.59pm on Saturday 16 th August 2025, the landlord is granted immediate possession after that date and time. Rent arrears:

The landlord has applied for rent arrears and has provided rent records which prove the amount owing. As of 8 August 2025, the rent arrears are $8165.00.

I am satisfied that the landlord has proven their claim for rent arrears. Bond and filing fee:

Because Prestige Rental Management Limited has wholly succeeded with the claim I must reimburse the filing fee.

The Bond Centre is to immediately refund the bond to the landlord to offset some of the debt owed by the tenant to the landlord. Tenants’ claims:
