Reasons

The landlord attended the hearing on 15 August 2025. The tenant did not.
On 20 March 2025, the Tribunal made an order terminating the tenancy and requiring the tenant to pay the landlord $6,377.58. The landlord has not received any payment from the tenant. Therefore, I incorporate the previous order application 5125596 into the terms of this order for enforcement purposes.
The landlord claims the tenant owes $9,612.00 in rent arrears and seeks a refund of the bond. The issues I must determine are: a. To what standard must the landlord prove their claim? b. Does the tenant owe the landlord rent arrears? c. Should the tenant reimburse the landlord the filing fee?

To what standard must the landlord prove their claim?

As the applicant, the landlord must prove their claim to the civil law standard of proof, on the balance of probabilities. This means that they must establish that what they are claiming is more likely than not. This is referred to as the “burden of proof.” Independent witnesses, corroborating documents and photographs are an important part of discharging this burden.
I do not need to be completely certain, but I need to be more certain than uncertain. In deciding any particular claim, I must consider all the evidence presented (including oral evidence at the hearing). I must weigh this evidence to decide what is more likely.

Does the tenant owe the landlord rent arrears?

The law

A tenant must pay rent as and when it is due and payable under the tenancy agreement. 1
If a tenant remains in occupation of the premises after the tenancy has ended, they must continue to pay rent until they cease to occupy the premises. 2 Analysis
The tenancy ended at 11:59pm on 23 March 2025 by order of the Tribunal. 1 Residential Tenancies Act 1986, section 40(1)(a). 2 Residential Tenancies Act 1986, section 60(1).
The landlord gave evidence the tenant remained in occupation of the premises until 23 May 2025. I accept the landlord’s evidence, which is supported by an eviction warrant dated 23 May 2025.
The tenant is responsible for paying rent up to 23 May 2025, which is the date they vacated the premises.
The landlord submitted a rent summary, which proves rent arrears are $9,612.00 up to 23 May 2025. The landlord has already secured an order from the Tribunal requiring the tenant to pay $6,350.58 in rent arrears up to 23 March 2025. The landlord’s rent summary proves that the total rent arrears between 24 March 2025 – 23 May 2025 are $3,261.42.
The landlord’s claim for rent arrears is granted for $3,261.42.
