Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing to Wednesday 6 August 2025. I have applied a further week rent to the total to reflect the amount owing to the end of the Tenancy.
The applicant indicated a willingness to consider a conditional termination order rather than an immediate termination. I made several attempts to explore this possibility with the respondent; however, he did not engage constructively, repeatedly spoke over me, and raised his voice. He asserted that the Residential Tenancies Act 1986 did not apply to him and referred me to schedule 3 of the Act, which contains a list of revoked regulations, as evidence for his position. He further stated that the collection of bonds was in his view, equivalent to the trading of slaves. I have considered these arguments and find that they have no merit.
The respondent also seemed to raise the question as to sovereignty and the treaty as his basis for rejecting the jurisdiction of the tribunal. In Tenant v Ngawhika and Pihema as trustees for The R N R Trust [2023] NZTT 4597910, the Tenancy Tribunal confirmed that the Residential Tenancies Act 1986 applies notwithstanding objections to its jurisdiction based on Treaty of Waitangi or Sovereignty arguments. In that case, the landlord challenged the Tribunal’s authority by invoking Treaty Principles, but the Tribunal rejected this and upheld the applicability of the RTA.
Because Eves Realty Limited has wholly succeeded with the claim I must reimburse the filing fee.
