This order is made by consent of the parties.
Atamira (Renee) Te Ao owes Compass Property Management Limited as Agent for Alex Rae $5,472.00 (“the debt”) calculated as shown in the table below.
Atamira (Renee) Te Ao must pay rent as it falls due (the next payment is due by Friday 29 August 2025 and thereafter by every Friday) and the debt must be paid in full by Tuesday 23 September 2025
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenant fails to pay the rent or the rent arrears within 2 working days of the due dates: a. The tenancy at Flat 4, 6 Buckland Road, Tuakau 2121 will terminate, and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee by the due date, it will be payable immediately.
For the avoidance of any doubt, this order will lapse if the rent arrears are paid by 25 September 2025 and rent is up to date.

Reasons

Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears and payment of the bond. The tenant wants to repay the debt to avoid immediate termination.
Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order.
There is a possibility that WINZ will pay the arrears for the tenant and the parties agreed to a conditional termination order that requires the rent to be paid as it falls due and allows 28 days for the arrears to be paid in full.
The conditional termination order will lapse if it is fully complied with. Full compliance will be achieved if the arrears are paid by 25 September and rent is up to date. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach.
I note that we did not discuss the claim for water rates at the hearing. I would expect that the issue can be resolved between the parties. I note that the claim is in the sum of $64.77 but there is an invoice in the sum of $41.43.
