Reasons

Both parties attended the hearing. The parties had the assistance of a Hindi interpreter.
Both parties applied in respect of the tenant paying the fixed charge for water during the tenancy.
It is clear in the Residential Tenancies Act (see section 39(4)(c)) that a tenant is responsible for charges incurred in respect of water on the basis of consumption. The fixed rate is not a charge on the basis of consumption.
The tenancy started on 9 April 2022 and ended on 28 March 2025.
The tenant realised in October 2024 that they had been paying the fixed water charge when they were not required to. The landlord also learnt of this and took steps to address the issue.
At the hearing neither party had clearly set out how much of the fixed charge was paid and therefore how much needed to be reimbursed. I have made the following calculations in respect of this issue on the evidence produced.
The fixed water charge for the period of the tenancy was $767.85 made up as follows: (a) $246.99 (2022) (b) $289 (2023-2024) (c) $231.86 (2025).
The figure for 2025 was $310.00 but $78.14 has been deducted for the remaining three months of the period after the tenancy ended; April 2025 $24.63, May 2025 $25.48, and June 2025 $28.03.
The landlord paid all the water (including the fixed charge) from August 2024 until the end of the tenancy. The amount of fixed charge during that period is $202.99. That amount is deducted from the full fixed water charge.
The water rates during the period from August 2024 to March 2025 paid by the landlord amounts to $440.83 which does not include the fixed water charge and is therefore the full amount payable by the tenant. That amount is deducted from the net fixed water charge.
The landlord provided evidence of two months (June 2022; $46.54 and July 2022; $59.94) where they paid the water rates in total. Neither invoice was provided for those months and therefore the amount of fixed water charge has not been calculated. The landlord produced a bank statement as proof of payment. That amount is deducted from the amount owed to the tenant. While the landlord has applied for suppression, I have not awarded this because the landlord has not succeeded with their claim in that this order determines that the tenant is owed for some of the water charges paid by them when they shouldn’t have.
