The landlord attended the hearing on 1 August 2025. The tenant did not attend.
The hearing was scheduled for 2:00pm and concluded around 2:30pm.
Around 2:50pm, the tenant arrived at the hearing room. By this time, the landlord and interpreter had left, and the hearing was not able to be resumed.
As the applicant, the landlord must prove their claim to the civil law standard of proof, on the balance of probabilities. This means that they must establish that what they are claiming is more likely than not. This is referred to as the “burden of proof.” Independent witnesses, corroborating documents and photographs are an important part of discharging this burden.
As noted by the District Court in Katipo v Clarke & McCarthy (DC) TT233/02, in practical terms this means that: ...[L]ike anyone who brings an application before a Tribunal or Court, it is incumbent upon the applicant to provide the evidence necessary to prove the case. The landlord gave evidence the tenant paid a bond of $3,200.00 at the beginning of the tenancy. The bond does not appear to have been lodged with the Bond Centre and therefore, it is appropriate that I deduct it from the total rent arrears owing at the end of the tenancy.
The landlord’s claim for rent arrears is granted for a total of $7,885.72. 1 Residential Tenancies Act 1986, section 55(1)(a).
