The hearing proceeded by way of video conference. Mr Khuttri, Property Manager, appeared for the landlord. The tenant failed to appear. Unsuccessful attempts were made to join the tenant to the hearing by telephone. I am satisfied that the tenant was properly served with the notice of hearing and the case proceeded in their absence.

The tenancy commenced on 31 October 2025 and is periodic.

On 7 July 2025, the landlord filed an application with the Tribunal seeking termination of the tenancy for breach of the tenant’s obligations, rent arrears, water rates, refund of the bond and reimbursement of the filing fee.

At the commencement of the hearing the landlord sort to amend their claim to include compensation for cleaning, carpet cleaning, rubbish removal and lawns.

The onus of proving these claims rests with the landlord. The standard required is on the balance of probabilities. The landlord must establish more likely than not that the tenant has breached the terms of the agreement or the provisions of the Residential Tenancies Act 1986 (the “Act”). Rent arrears

At the date of filing the tenant’s arrears totalled $2,228.46. Rent is $600.00 per week. The rent was at least 21 days in arrears when the application was filed. At the date of hearing the tenant’s rent arrears totalled $3,428.57. The tenancy is terminated. The amount claimed is awarded.

The landlord seeks immediate possession of the property. The landlord told the Tribunal the tenant continues to accrue rent arrears, and visits to the property on 4 July and 9 July 2025 appear to indicate the tenant has either abandoned the property or is the process of moving out.

Having heard from the landlord, the Tribunal is satisfied that it is appropriate to terminate the tenancy at midnight on 28 July 2025.

Water rates

The landlord seeks water rates totalling $445.65.

The landlord provided a two water rates invoices. The first invoice was for the period 4 February 2025 to 3 April 2025. The water use charges total $188.02. The second invoice is for the period 4 April 2025 to 5 June 2025. The water use charges total $201.63.

The Tribunal is not satisfied that the claim of $445.65 is supported by the evidence and appears to include other costs. The landlord is awarded $389.65 for water rates charges to 5 June 2025. Compensation for cleaning, carpet cleaning, rubbish removal and lawns

Section 91(2) of the Act states that the parties will be fairly informed of the substance of the matters to be dealt with at the hearing.

At the hearing, the landlord sort to amend their application to include compensation for cleaning, carpet cleaning, rubbish removal and lawns. The landlord sort to rely on evidence filed at 7.12am on the day of the hearing.

The Tribunal declines to amend the claim or hear the matter. The tenant was not made aware of the landlord’s intention to seek compensation, section 91(2) of the Act and the principles of fairness and natural justice apply.

The landlord is not prevented from filing a future application for compensation for these claims. Costs and Name Suppression
