Reasons

The landlord attended the hearing represented by Ms Flynn.
Ms Russell did not attend and did not answer the calls made to her phone during the hearing. She had been notified of the hearing by email and text, accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in her absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 RTA. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
The evidence establishes that on 9 July 2025, when they attended the property for an inspection, the landlord became aware that the tenant had abandoned the premises. The property was emptied, and Ms Russell was not responding to attempts to contact her.
Because I am satisfied that the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice, see section 61(3)(b)(ii) RTA. The landlord has secured a replacement tenancy that is to commence on 1 August.
Because Stable Property Management Limited As Agent For Joshua Mossman has wholly succeeded with the claim I must reimburse the filing fee.
