Only the applicant attended the hearing which took place by videoconference. The tenant was called on the number provided three times and the calls went to voicemail.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and reimbursement of the filing fee.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 9 July 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The property manager advised that she went to the address and discovered that the electricity was turned off and the beds were stripped and it appeared no one was living at the premises.
The property manager advised that she returned to the premises on 23 July 2025 and did a property inspection. She provided a copy of photographs taken on that day. The inspection report records “The home has been empty for some time now...the tenant has come and gone and taken more items”.
The rent is more than 21 days in arrears and the property manager advised that no rent has been paid since 27 May 2025.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice. When a landlord seeks termination for abandonment the Tribunal may order rent arrears to 21 days after the date specified as the date the landlord became aware the premises were abandoned.
