She stated that the landlord began painting and replacing the carpet but left the work incomplete, leaving the property in poor condition. She said that she and her mother were moved into a one-bedroom unit, which still contained another person’s belongings, and were then told to move back the same night. She alleged that the situation escalated into altercations with security guards, after which she contacted police on two occasions. She also said she had written to Mr. Shukla stating that she would not pay rent until the repairs were completed. Mr Shukla’s reply
Mr. Shukla confirmed that some renovations had started but said the work was more extensive than first thought. Full replacement of the carpet and repainting could not be carried out while the tenants remained in the property. He stated that he did not respond further to Ms. Williams’s messages to avoid being accused of harassment. He maintained that rent remained payable despite these issues. My view
Ms. Stacee Williams was given an opportunity to file her claims with Tenancy Services after the Tribunal granted an adjournment on 14 August 2025. She did not do so.
Accordingly, I am only adjudicating Mr. Shukla’s termination application today.
Ms. Stacee Williams may contact Tenancy Services for assistance if she wishes to file a claim against Mr. Shukla. Rent arrears and bond
Mr. Shukla provided an updated rent summary showing arrears of $6,550 as at 1 September 2025. Upon further examination, the correct rent arrears to 1 September 2025 are $6,284.29. The figure of $6,550 reflects arrears as at 4 September 2025.
Mr. Shukla also confirmed that no bond was available in the Bond Centre, as only $20 or thereabouts remained from the previous landlord when he took over the property. Ms. Williams disputed this, stating that she and her mother had paid a bond through WINZ. She also alleged that Mr. Shukla had provided false invoices to WINZ, but these matters were not part of the current application. Ms. Stacee Williams may file her own application with the Tribunal if and when she is ready. Agreement on vacate date
During the hearing, Ms. Stacee Williams indicated that she and her mother were willing to vacate the property by 16 September 2025. I explained that the tenancy would be terminated as of the date of the order (i.e. today), but that possession would not return to the landlord until 17 September 2025, the day after the agreed vacate date.
Mr. Shukla did not oppose the tenants remaining in the premises until 16 September 2025. Conclusion
The landlord has applied for termination of the tenancy, and rent arrears.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
I am satisfied that Mr. Shukla has proved his case on the balance of probabilities. Accordingly, the tenancy is terminated, and possession will revert to Mr. Shukla at 11.59 pm on Tuesday, 16 September 2025. Filing fee
Because Hemal Prakash Shukla has wholly succeeded with the claim I must reimburse the filing fee.
